Sharing a Rented House or Flat…
Before a property can be sub-let the tenant must have your written permission.
The Head-tenant (the person whose name is on and has signed the original residential tenancy agreement) gives another person (the sub-tenant) the right to occupy all or part of the rented premises, but the tenancy agreement stays in their name.
The sub-tenants name is not on the original agreement but should enter into a residential agreement with the head-tenant.
Sub-letting Your Tenancy
Sub-letting often occurs in share housing where there is a high turnover of tenants.
The head-tenant then has a Landlord’s relationship with the sub-tenant, whilst remaining responsible to you for rent, any damages, repairs, etc.
Before agreeing to sub-letting, assess the property and any potential issues that may arise, decide on how many people you can accommodate and adjust within your premises.
As the Landlord you can refuse to sub-let even without reasonable grounds.
